Claiming Compensation for Personal Injuries

Under English law you can generally only recover compensation for injuries and associated financial losses if you can show that someone else was at fault and that this caused loss and damage to you.

Virtually all personal injury compensation claims are settled out of Court. However‚ the person against whom you are claiming is still referred to as the Defendant and we will always need to consider what a Judge would decide if your case did go to Court.

In practice‚ if the Defendant is insured‚ it will be the insurance company which will conduct the claim in the Defendant’s name and which will pay any compensation and costs.

What can I claim for

We will be able to give you an assessment after we have received an independent medical report on your injuries and after we have been able to calculate your financial losses.

You can claim compensation for the ‘ heads of damages ’ listed below :

● Damages for pain‚ suffering and disability caused by the injuries themselves.
● Compensation for expenses and other losses incurred as a result of the injuries.
● Compensation for loss of earnings.
● Compensation for possessions damaged‚ destroyed or lost.
● The value of care provided to you by others if you were not able to look after    yourself.
● Interest on all the above.
● Compensation for future losses and expenses where there are ongoing needs.

What if the other driver is not insured or fails to stop?

If you have been involved in a road traffic accident with an uninsured driver or the driver leaves the scene of the accident and is therefore untraced you can still claim
compensation.

The Motor Insurers Bureau exists as a fund of last resort to provide a safety net for the innocent victims of uninsured and untraced motorists. The MIB also administers the Green Card Scheme to compensate the victims of foreign motorists in the UK.

Industrial accidents

If you have been involved in any accident at work during the course of the last three years then you may be able to claim no matter how trivial you think the accident may be.

   Licensing

The new licensing act

The act introduces a new system for dealing with licences. The responsibility for licensing
the sale of alcohol has now moved from the Magistrates to the Local Authorities.

There are now separate licences for you personally and for your premises. A premises
licence will be the most common type of permission. This covers both the provision
of alcohol ‚ entertainment and even service of hot food after 11:00pm. You will
also need a personal licence if you wish to sell alcohol.

There are no set hours under the new law and it is possible to apply for up to
24 hours a day trading. Each application is considered by a number of bodies
including the police and local residents ‚ so it is important that the application
is drafted carefully in order that you achieve the licence conditions you desire.
